Fair Usage Policy

This Fair Usage Policy explains how Unlimited Data Plans provided by TNS eSIM operate and outlines the acceptable use of these plans. It applies to all unlimited data packages purchased through the TNS eSIM website, mobile applications, or any other TNS eSIM platform.

1. About this Policy

This policy forms part of, and should be read together with, our General Terms, Terms of Service, and Acceptable Use Policy.

Throughout this policy, “TNS eSIM”, “we”, “our”, or “us” refers to Novatel Traders (SMC-Private) Limited / BAWABAT AL KHAIR GEN TRDG LLC.

By purchasing, activating, or using an Unlimited Data Plan, you acknowledge that you have read, understood, and agreed to this Fair Usage Policy.

2. Personal Use

Unlimited Data Plans are intended solely for normal personal use. You may use your plan for everyday online activities including:

  • Web browsing
  • Email
  • Social media
  • Messaging applications
  • Video and voice calls
  • Music and video streaming
  • Navigation and maps
  • General mobile internet usage

You may also use your device as a personal hotspot (tethering) to connect other personal devices. Unless otherwise specified for a particular destination or network, TNS eSIM does not impose a separate limit on tethering or the number of connected devices.

3. What “Unlimited” Means

Unlimited Data Plans do not include a fixed total data allowance. To ensure a consistent experience across the network for all users, a daily high-speed data allowance applies.

Once you consume 3 GB of high-speed data within a 24-hour period, your connection speed will be reduced to 1 Mbps for the remainder of that 24-hour cycle. Your full high-speed data speed will automatically be restored when the next usage cycle begins.

The standard daily high-speed allowance is 3 GB. Where a different allowance applies, it will be clearly displayed on the product page before purchase.

For the purposes of this policy, each “day” refers to a rolling 24-hour period beginning at the time your eSIM is activated, unless otherwise stated in your plan details.

4. Using Data After the Speed Reduction

Even after your speed has been reduced to 1 Mbps, you can continue using your data connection for many everyday tasks, including:

  • Messaging
  • Email
  • Basic web browsing
  • Navigation and maps
  • Social media
  • Standard-quality voice and video calls

Activities requiring higher bandwidth—such as HD or 4K video streaming, online gaming, cloud backups, or downloading large files—may perform more slowly until your high-speed allowance resets.

5. Prohibited Uses

To protect network integrity and ensure fair access for all customers, Unlimited Data Plans must not be used for activities including, but not limited to:

  • Reselling, redistributing, or commercially providing internet access to third parties.
  • Operating SIM farms, automated systems, machine-to-machine (M2M) services, bulk messaging platforms, auto-dialers, or similar automated technologies.
  • Running services or applications that place excessive or continuous demand on the network, including persistent peer-to-peer file sharing, hosting servers, or continuous large-scale uploads or downloads.
  • Using the service for unlawful, fraudulent, or abusive activities.
  • Attempting to bypass, interfere with, or circumvent any traffic management or network management measures implemented by TNS eSIM or our network partners.

TNS eSIM reserves the right to determine, acting reasonably and in good faith, whether a particular use violates this policy.

6. Network Management

Our services are delivered through partner mobile network operators around the world.

During periods of high network demand, these operators may apply their own traffic management policies or congestion controls. Such measures may temporarily affect connection speeds or service quality independently of the daily high-speed allowance described in this policy.

Because these measures are controlled by the underlying network operators, TNS eSIM cannot guarantee uninterrupted service or any specific download speed, upload speed, latency, or network availability.

7. Breach of this Policy

If TNS eSIM reasonably believes that an Unlimited Data Plan is being used in breach of this Fair Usage Policy, we may, without prior notice:

  • Temporarily suspend or restrict your service.
  • Suspend or terminate your TNS eSIM account.
  • Cancel the affected data plan without refund where permitted under applicable law.
  • Take any other reasonable action necessary to protect our services, network partners, and other users.

Any breach of this Fair Usage Policy may also constitute a breach of our General Terms and Acceptable Use Policy, and the remedies available under those documents shall also apply.

8. Changes to this Policy

TNS eSIM may revise or update this Fair Usage Policy from time to time.

Where material changes are made, we will notify customers in accordance with our General Terms. Updated versions become effective from the date they are published and will apply to Unlimited Data Plans purchased or activated after that date unless otherwise required by applicable law.

9. Governing Law

This Fair Usage Policy shall be governed by and interpreted in accordance with the laws governing the legal entity operating TNS eSIM, unless otherwise required by applicable consumer protection laws.

Any disputes arising from or relating to this policy shall be resolved in the courts having jurisdiction over TNS eSIM’s registered legal entity, subject to any mandatory rights granted to consumers under applicable law.
